SCRAP METAL DEALERS APPLICATION
Matter for Consideration:
To consider an applicant who has been convicted of offences or who has otherwise given reason for concern.
Information:
The Scrap Metal Dealers Act 213 came into force in October 2013. The Act makes it an offence to carry on business as a scrap metal dealer without a licence.

There are two types of licence that can be granted. A site licence, where the dealer operates from premises, and a collector’s licence, where the dealer operates as a mobile collector.

A licence may only be granted to an applicant who is suitable to hold a licence. To assist in determining suitability, the Council has approved a policy on issuing licences under the Scrap Metal Dealers Act 2013.

The Cabinet Member was asked to determine whether the following applicant is a suitable person to be licensed as a scrap metal dealer:

Recommendations:
The Cabinet Member is requested to determine whether the applicant is a suitable person to be licensed as a scrap metal dealer.

Decision:
The Cabinet Member resolved as follows: To grant the application for a Scrap Metal Collectors Licence subject to issuing of a severe warning letter that in the event of further concerns the licence will be reconsidered and may be revoked.

Reason for Decision:
The Cabinet Member considered all the relevant evidence including the Licensing Policy and the oral submissions of the applicant and concluded that this action was proportionate based on this information.
